Ash Bidhendi

Ash is a founding director of Precision Legal, who practises in the wills and estates team and the criminal law team, working primarily in relation to wills, estates and probates, civil litigation and criminal law.

Ash is admitted as a solicitor and barrister in the Supreme Court of South Australia and the High Court of Australia.

Ash commenced his legal career in the area of criminal and disciplinary law, during which he gained significant advocacy experience in different South Australian Courts and disciplinary tribunals. Ash has closely collaborated with experts and senior barristers in relation to a range of disciplinary matters, including serious criminal charges. Ash’s prior experience has provided him with the skills to passionately advocate for his clients’ best interests, conduct complex litigation and collaborate with other industry experts to achieve the best results for his clients.

In addition to his professional experience, Ash has provided substantial support to various charities and community organisations, including assisting the Childhood Cancer Association Incorporated bequest program, assisting charities at ‘Wills Day’ events, and providing young professionals with invaluable knowledge and guidance as a mentor and supervisor to final year law students through the Flinders University Transactional Legal Practice Mentoring Scheme. Previously, Ash has worked with community legal centres and has been a Judge at university mooting and advocacy courses. Ash’s volunteer work reflects his passion for access to justice, which he contributes to by providing legal advice to clients from a range of cultural backgrounds, facilitated by his fluency in both Farsi and English.

Areas of Practice

Wills, Estates and Estate Litigation

Ash approaches estate planning matters holistically, advising our clients on a wide range of necessary considerations, including taxation, asset protection in bankruptcy, property settlement, estate challenges and practical considerations of succession planning for companies and trusts. Ash frequently provides estate planning advice to individuals with high-value estates, often incorporating complicated company structures, which require careful consideration and also regularly conducts presentations to other professionals in this area.

Ash is a full member of the Society of Trust and Estate Practitioners, which is an international organisation for practitioners who specialise in succession planning, trusts and estates. This membership allows Ash to collaborate with other industry professionals and provides access to a broad range of academic materials and industry knowledge.

Criminal Law

Ash has conducted trials and appeals, both as solicitor and counsel, in relation to a broad range of disciplinary matters. This includes, but is not limited to, complex murder trials, traffic offences, drug-related offences, and weapons offences. Ash’s expertise and experience in criminal law allows him to consider, from the outset, which strategic approach is most likely to result in an ideal outcome for his client.

Ash believes that such considerations are particularly important in the criminal jurisdiction, in which the outcome of a matter will impact upon his clients’ livelihood, liberty and future prospects. Ash also assists clients in circumstances where no charges have been laid (such as where there are preliminary hearings, interviews, and investigations), and is aware that in such matters a patient and considered approach is necessary to ensure that his clients’ rights are not unfairly prejudiced.

Sports Law

Ash is involved with a number of state and national sporting institutions and tribunals, both as an advocate and tribunal member. Ash’s involvement in sporting institutions allows him unique insight into sport-related legal disputes, and accordingly into what strategies are best adopted to achieve an ideal outcome for his clients. Ash approaches sporting matters realistically, ensuring that his clients are well informed as to their prospects of success, and what challenges they may face during a dispute.

Ash has been involved in many high-profile SANFL, AFL and AFLW tribunal matters, including appealing tribunal decisions such as the Ebony Marinoff appeal in 2021, novel cases such as the first de-registration of an SANFL player, and the SANFLs ‘19th man saga’ of 2018.

Employment Law

Ash has experience representing both employees and employers in complex employment disputes, and has appeared on behalf of his clients in both the Fair Work Commission tribunal, and the South Australian Employment Tribunal.

Ash has particular experience in providing employment advice to small businesses, and as a small business owner himself understands how to competently balance his clients’ commercial interests with the specific legislative requirements which apply. Select examples of Ash’s employment law experience include:

1. preparing, reviewing and amending employment and contractor agreements;
2. advising small business owners in relation to corporate restructures and associated redundancies; and
3. making jurisdictional arguments in relation to notice requirements and unfair dismissals.
